This Agreement shall govern participation in the
Traffic Service. By using this service, you are agreeing to be bound by these
Terms and Conditions.
TRAFFIC SERVICE ACCEPTABLE USE POLICY
Ads containing pop-ups must select "multi-pops" from the quote form
or from their accounts to run campaigns that include any windows that pop up on
entry or exit to your page. If you get your ad approved and decide to add a
pop-under or other pop-up after approval, your campaign will be suspended.
Current Promotional Campaigns do not support pop-ups, however you can run campaigns
containing pop-ups by creating your own multi-pops unrestricted pop-under
package (PopUnder - No Restriction) from the custom quote form.
GUARANTEE:
First... We do not guarantee sales or an
increase in sales! No one can, if they have integrity.
To make sales you need the right amount of
traffic with the right mix of content, the right offer and also compelling
incentives on your web site.
Here's our guarantee:
If you don't get the number of visitors or impressions you
purchased within 30 days (except for pay per click or click thru campaigns
which run until your ordered quantities are met) you will be refunded on a pro-rata basis. We
use state of the art ad-serving technology within a mass network of sites to
ensure that internet users will not see the same advertisement more than once
during the entire duration of your campaign. NO WASTED ADS!
FEEL FREE TO USE YOUR OWN STATISTICS PROGRAM TO VERIFY!
Our Full Page Pop-Unders (not banner ads) will bring visitors
directly to your site or the url of your choice. So your site will be shown in
a full browser window 10,000 or 100,000 or 1,000,000 times (whatever you
choose) as we send people (guaranteed visits) to your site
via full page pop-under campaigns only.
Banner ads are based only on impressions. We will show your banner
ad 10,000 or more times (whatever you choose), however, that does not guarantee
that anyone will click on the banner ad to go to your site. No
one can guarantee visits for banner ad or impression only campaigns.
Out of this guarantee,
all sales are final, we do not refund at
all.
General Definitions: (We sell
unique visits - pop-under traffic - not just hits)
Visits: Visits are counted when one or more visitors
loads your web page.
Unique Visits: Are visits to a web page by different
people (unique) within a given period of time (24 hours) who have not
reloaded/refreshed their browsers.
Hits: Hits are actually counted every time an element is
loaded from your web page (ex: the page itself is one hit, each image is
counted as a hit, so a page with 5 images would count as 6 hits). Hits can be
deceptive and some companies sell hits and not real visitor traffic.
Multi-Pop Unders: Are used for ad campaigns that contain
pop-ups. You must use multi-pops if your campaign destination page or ad
contains an automatic pop-up. Select the number of pages spawned (popped,
launched) from the order drop-down menu when you request a quote.
Pop-Under Ads: Are ads, that automatically launch a
web page behind an open browser window. Ads will become visible when main
window closes, does not rely on pop-ups and is less annoying to viewers.
Banner Ads: Are advertisements that can be placed anywhere
on a web site page. You've seen them all over the internet. Usually 468x60
pixels in size.
Var/Rich Media: Banner Ads banner advertisements that can
contain video, animations, audio on demand (must use a link or button to play
sound-- not auto-play), multimedia, etc. created using Flash, JavaScript, Java
etc.
Unacceptable Content:

We do not accept Porn, Sex, Hate, Bigotry,
Violence related sites.

Campaign destination pages cannot contain pop-ups
(this becomes annoying and angers visitors when stuff starts popping up all
over their screens. Don't do it! Not good for your potential customer and not
good for your sales either).

No adult sites or other sites that may be
involved with illegal material.

You may not have any popups (popups,
pop-behinds, or exit popups) on the page we send the hits to unless you
selected that option.

No Frame Breaking code.

No scripts that alter user's browser settings.

No background sound on your landing page (the
page you are advertising). Visitor must be able to click button or link to hear
sound.
We participate in a proven network ensuring that
advertisers get real quality visitor traffic. If you alter your landing page
content after approval by adding any of the above materials, your campaign
account can be suspended or terminated without refund.

YOU MUST AGREE TO THESE TERMS:
You are guaranteed that
TopTrafficWholeSaler.com
will send the number of visitors to the URL you specify. This is the only
guarantee for this service. Out of
this guarantee, all sales are final, we
do not refund at all. In no event shall
TopTrafficWholeSaler.combe liable for any consequential, direct, indirect, incidental, punitive, or
other damages whatsoever (including, but not limited to, damages for loss of
profits, loss of information or other pecuniary loss) arising out of the use or
inability to use the package, even if
TopTrafficWholeSaler.com
has been advised of the possibility of such damages.
This guarantee applies to "Guaranteed Visitors" which encompasses "Exit
Popunders" and "Banner Ads" and EXCLUDES those campaigns which rely on a
visitor clicking on the actual presented element to be counted
(Charge-per-click [CPC] banner or text ads; Pay-per-Click (PPC) search engines;
and email campaigns are part of this excluded group). If we are
unable to deliver the number of visitors promised, you may claim a refund
within 30 days of purchase. In the unlikely event that
TopTrafficWholeSaler.com
does not deliver the number of visitors promised, we will provide a refund of
your purchase price on a pro-rata basis. In cases where refunds are claimed, we reserve the right
to require proof that the proper number of visitors were not delivered. Stats,
data and other information from third party counters (e.g. Extreme-DM.com,
hitbox) are not sufficient to establish a claim. These counting systems tend to
yield an improper count. If we dispute your claim, you must provide us with RAW
server logs from the site and time period in question - this is the only
reliable method of counting a visitor.

will not deliver visitors to sites containing content that is not appropriate
for viewing by a general audience. Inappropriate content includes, but is not
limited to, hate text, illegal content (in the US) and content that encourages
illegal activities or violence. What constitutes inappropriate content shall be
determined at the sole discretion of

will review your site before beginning the campaign. If your site is changed
during the campaign such that it includes inappropriate content,
TopTrafficWholeSaler.com
may stop your campaign immediately. In this case, you will
not be provided a refund
on a pro-rata basis.
TopTrafficWholeSaler.com
will deliver visitors to sites with NO popup windows unless you selected that
option. Any additional window generated by your site shall be considered a
popup window, including popunder windows and JavaScript alert windows. If an
extra popup window is installed on the URL at any time after the campaign
begins,
TopTrafficWholeSaler.com
may stop the campaign and you will not be entitled to a refund.
TopTrafficWholeSaler.com
cannot be held responsible for factors beyond our control that may interfere
with our ability to deliver visitors to your URL. Such factors include, but are
not limited to: downtime on your server, overuse of your bandwidth quota (if
applicable), errors on your site and network outages beyond our servers, Page
load errors on your site, visitor traffic congestion, slow loading pages and
other related issues. Please contact your web hosting company or network
provider if you are unsure about whether your hosting account is sufficient for
the program you are ordering.
This Agreement is the entire agreement between you and
TopTrafficWholeSaler.com
and supersedes any other understandings or agreements, including, but not
limited to, advertising with respect to the package.
TERMINOLOGY: (1) In the
present context, a visit generally occurs when a text file is loaded from your
server (this includes HTML files). A hit occurs when a file is loaded from your
web server. Since loading a single web page can cause several files to load
(e.g. images), several hits usually occur when a page is loaded. Thus, the
number of hits is always greater than (or equal to) the number of visits. The
term “number of visitors” is interchangeable with the term “number of visits.”
Several “visits” may originate from a single IP address or individual. This
generally occurs when an individual returns to or reloads a webpage. (2)
“Pro-rata” refunds are calculated by dividing the number of visits we delivered
by the number of visits you ordered. The result of this calculation is
subtracted from 1 and the resulting figure is multiplied by your purchase price
to derive the “pro-rata” refund.
If any provision of this Agreement is deemed invalid or
unenforceable by any jurisdiction or government agency having jurisdiction,
that particular provision will be deemed modified to the extent necessary to
make the provision valid and enforceable, and the remaining provisions will
remain in full force and effect.
